Competition and Giveaway Terms and Conditions
1. Eligibility
1.1. The competition or giveaway is open to South African residents aged 18 years or older at the time of entry.
1.2. The competition is not open to employees of ELA Exotic Leather Accessories, their immediate families, the prize sponsors, their respective advertising agencies, PR companies, or their agents.
1.3. By entering the competition or giveaway, participants agree to these terms and conditions.
2. Entry Requirements
2.1. To enter, participants must follow the instructions provided in the competition or giveaway announcement.
2.2. No purchase is necessary to enter or win.
2.3. Only one entry per person is permitted unless otherwise stated in the competition or giveaway details.
2.4. When the competition or giveaway requires tagging a friend, participants are not allowed to tag businesses.
3. Prize
3.1. The prize(s) offered in the competition or giveaway will be clearly stated in the announcement.
3.2. Prizes are non-transferable and no cash or other alternatives will be offered.
3.3. ELA Exotic Leather Accessories reserves the right to substitute a prize of equal or greater value in the event that the advertised prize becomes unavailable.
4. Winner Selection and Notification
4.1. Winners will be selected at random or based on the criteria specified in the competition or giveaway announcement.
4.2. The judges’ decision is final and no correspondence will be entered into.
4.3. The winner(s) will be notified within 3 days of the closing date via the contact details provided during entry.
4.4. If the winner does not respond within 3 days of being notified, ELA Exotic Leather Accessories reserves the right to withdraw the prize and select an alternative winner.
4.5. If the winner resides outside of Cape Town and needs to travel to Cape Town for prize collection, this will be at the winner’s own cost.
5. Publicity
5.1. By entering the competition or giveaway, participants agree to the use of their name, likeness and entry for promotional purposes in any media, without additional compensation or prior notice.
5.2. Winners may be required to participate in reasonable publicity related to the competition or giveaway.
6. Liability
6.1. ELA Exotic Leather Accessories accepts no responsibility for any damage, loss, liabilities, injury, or disappointment incurred or suffered as a result of entering the competition or giveaway or accepting the prize.
6.2. ELA Exotic Leather Accessories is not responsible for any problems or technical malfunction of any telephone network or lines, computer systems, servers, or providers, or any failure of any entry to be received on account of technical problems or traffic congestion on the internet or any website.
7. General
7.1. ELA Exotic Leather Accessories reserves the right to cancel or amend the competition or giveaway and these terms and conditions without notice. Any changes will be posted either within the competition or giveaway announcement or these terms and conditions.
7.2. ELA Exotic Leather Accessories’ decision in respect of all matters to do with the competition or giveaway will be final and no correspondence will be entered into.
7.3. By entering this competition or giveaway, participants agree to be bound by these terms and conditions.
7.4. These terms and conditions are governed by the laws of South Africa and any disputes will be subject to the exclusive jurisdiction of the courts of South Africa.
8. Miscellaneous
8.1. Participation in the competition constitutes acceptance of the competition rules and entrants agree to abide by the rules.
8.2. Except as provided for in the Act 68 of 2008, the judges’ decision is final and no correspondence will be entered into.
8.3. All queries in connection with the competition should be directed to info@exoticleather.co.za.
8.4. By submitting your information (contact details), you agree to receive communication from ELA Exotic Leather Accessories and associated brands or sponsors.
8.5. ELA Exotic Leather Accessories reserves the right to publish the name(s) and/or photograph(s) of the winner(s).
8.6. The prize(s) for social media competitions and giveaways will go to the first name(s) selected at random after the closing date.
8.7. If you haven’t claimed your prize or responded to communication regarding your prize within 3 days, you will unfortunately forfeit the prize. ELA Exotic Leather Accessories reserves the right to redistribute all unclaimed prizes.
8.8. ELA Exotic Leather Accessories shall have the right to terminate the competition immediately and without notice for any reason beyond its control requiring this. In the event of such termination, all participants agree to waive any rights that they may have in terms of this promotion and acknowledge that they will have no recourse against the Promoter, its agents and staff.
